Transcript of Memo from Officer H.L. Williams

On 3/23/08 approximately 10:00 p.m. I received a bolo to the area of U.S. 1 in reference to a vehicle-traveling north in the southbound travel lane. Officer Hobgood and I waited at U.S. 1 at N.C. 39 on ramp. We received a call that the vehicle was passing Hwy. 39 with the complainant following the vehicle with their hazard lights on. Then Deputy Kincaid pulled over on the shoulder in front of us. I saw the suspect vehicle go under N.C. 39 heading north in the northbound lane. I pulled onto the on ramp behind Deputy Kincaid. When I reached the bottom I pulled over to the should again to allow Deputy Daniels to pass me and catch up to Deputy Kincaid. Deputy Kincaid stopped the vehicle approximately one mile north of the city limit sign. Deputy Kincaid and Deputy Daniels were already speaking to the driver. The deputies had Mrs. White step out of the vehicle. I could tell she had red glassy eyes was unsteady on her feel, very strong odor of alcohol coming from her breath. Mrs. White had slurred speech as well. I was attempting to find the registration for the vehicle and I saw an empty cup inside the vehicle, on the right front passenger floorboard. I saw Deputy Daniels attempt to administer a P.B.T. and she was unable to get a sufficient sample. I heard Officer Hobgood ask Deputy Daniels when did she blow, she stated it was only a quick puff no reading given. I also noticed that Mrs. White appeared to have urinated on herself, due to the location of the wetness as well as smell from inside the vehicle. I then saw Deputy Daniels try to administer another P.B.T. Mrs. White then hit Deputy Daniels in the right forearm and stated, “I ain’t taking no test I am going to sit in my vehicle and wait until my father gets here.” Mrs. White then walked back to the vehicle and got inside with the vehicle running. Officer Hobgood and I went to the drivers’ door. Officer Hobgood held Mrs. White back while I removed the keys from the vehicle. I heard the dispatcher call Deputy Kincaid and advised him to cal dispatch. I over heard Deputy Kincaid say this is Sheriffs White daughter, and then heard him say you had better call the supervisor at home. I saw that Mrs. White had damage to the driver’s side of the vehicle. The damage caused both the drivers and passengers door handle to malfunction. There was extreme paint damage to the side of the vehicle as well. I gave the keys to Deputy Kincaid. Officer Hobgood and myself then walked back to the our Patrol car and cleared the scene.

On 3/23/08 at approximately 2200 hrs. I received a BOLO in the area of U.S. 1 in reference to a vehicle traveling north in the southbound lanes. Officer H. Williams and I waited on the entrance ramp to U.S. 1 from N.C. 39. After about 15 minutes central advised that the suspect vehicle was being followed by the complainant who had their hazard lights on and they were fixing to com under N.C. 39. Just before the suspect vehicle passed by our located Deputy Kincaid pulled over the left shoulder just in front of our location. As the vehicle passed by our location Deputy Kincaid pulled off and started down the entrance location. We also started down the entrance ramp and just as we got to the bottom of the ramp Deputy Daniels passed by and pulled in behind Deputy Kincaid. Deputy Kincaid stopped the vehicle about 1 mile north of the city limit sign in the county. When we pulled up to assist the deputies they where already talking to the driver. As Deputy Kincaid walked back toward his patrol vehicile, I asked him if she was drunk and he said man she is blistered. AS I walked up on the driver’s side of the vehicle while the Deputies were talking to the driver, again I could see the entire driver’s side of the vehicle was damaged. The Deputies then asked the driver to step out of the vehicle. As the driver stepped back to the rear of her vehicle where the Deputies were, I could see that she was very unsteady on her feet. As she was talking to the Deputies I could see that her eyes were red and glassy, her speech was slurred and she had a very strong odor of alcohol coming from her mouth as she spoke. I could also see that she had urinated in her pants due to the location of the wetness and smell about her person. Deputy Daniels then tried to administer a P.B.T. and received no reading due to an insufficient sample. As Daniels tried to administer the P.B.T. again the driver slapped Daniels on the right forearm and said get that shit out of my face my daddy is the Sheriff. The driver who I then found to be Mrs. White said that she was going to sit in her vehicle until her father got there. Officers Williams and I went to the driver’s door because the vehicle was still running. I held Mrs. White back while Officer Williams turned the vehicle off and removed the keys from the ignition. Officer Williams then give the keys to Deputy Kincaid. I then heard dispatch tell Deputy Kincaid to call as soon as he could. While Kincaid was on the telephone I heard him say, you need to call him at home and see what he wants to do. I then asked Kincaid if he needed our assistance any longer. He told me that he would be OK so Officer Williams and I went back to our vehicle and cleared the scene.
